San Francisco’s district attorney will not charge filmmaker Kevin Epps in the fatal shooting of a man found dead in his house, the San Francisco Chronicle reports.

The announcement came Tuesday night after the prosecutor determined there was insufficient evidence—at this time. Epps was arrested on suspicion of murder and possession of a firearm as a felon for the fatal shooting on Monday afternoon.

Following his release, Epps and his attorney said that Marcus Polk was an intruder who made “serious threats” and was shot in “self-defense,” the Chronicle reported.

The police did not released details about the fatal shooting, and Epps’ attorney has declined to elaborate on what happened.

Epps, 48, produced documentary films that examined the violence and neglect in his San Francisco neighborhood. He’s best known for his 2001 film Straight Outta Hunters Point, and its sequel.

According to The Chronicle, Polk, 45, was a registered sex offender with a conviction record that includes robbery and domestic battery. It’s unclear why Polk went to Epps’ house, but the two men knew each other.

The newspaper spoke with an unidentified woman who admitted to using drugs in the past with Polk. She told the Chronicle that Polk became addicted and homeless 10 years ago when his mother died.
